A spinal cord injury can permanently alter the course of your life in seconds. These catastrophic injuries often result in paralysis, chronic pain, and lifelong medical needs that create enormous physical, emotional, and financial burdens. If you or a loved one has suffered a spinal cord injury due to someone else’s negligence, understanding your legal options is critical to securing the compensation you’ll need for the road ahead.
What Is a Spinal Cord Injury?
According to the Cleveland Clinic, a spinal cord injury (SCI) happens when there’s damage to your spinal cord—a thick bundle of nerve fibers that allows your brain to communicate with nerves throughout your body. These injuries can range from minor and manageable to severe and permanent.
Your spinal cord functions like an expressway connecting your brain to the rest of your body. Signals travel down from your brain to control movement and up from your body to provide sensory information. When the spinal cord is damaged, these signals can be partially or completely interrupted, affecting everything from muscle control to sensation to organ function.
The Mayo Clinic notes that spinal cord injuries affect every aspect of life, and the impact depends on where the injury occurs along the spine and how severe it is.
Types of Spinal Cord Injuries
Spinal cord injuries are classified in two primary ways: by location and by completeness.
By Location
The spine is divided into regions, and the location of injury determines which body functions are affected.
Cervical injuries (neck region) are the most severe. Injuries to the C1-C4 vertebrae can affect breathing and may require ventilator support. Injuries to C5-C8 typically result in quadriplegia (also called tetraplegia)—paralysis affecting all four limbs.
Thoracic injuries (upper and middle back) generally result in paraplegia—paralysis of the legs and lower body—while allowing full use of the arms and hands.
Lumbar and sacral injuries (lower back) affect the legs, hips, and pelvic organs but typically allow for greater mobility than higher injuries.
By Completeness
Complete injuries mean there is no motor or sensory function below the level of injury. The connection between the brain and body parts below the injury site is entirely severed.
Incomplete injuries mean some function remains below the injury level. The degree of function varies widely—some people retain significant movement and sensation, while others have very limited function.
Common Causes of Spinal Cord Injuries
Spinal cord injuries most commonly result from traumatic accidents. Leading causes include:
Motor vehicle accidents. Car crashes, motorcycle accidents, and truck collisions are the leading cause of spinal cord injuries, accounting for approximately 38% of new cases annually. The violent forces involved can fracture vertebrae, dislocate the spine, or directly damage the spinal cord.
Falls. Falls are the second most common cause of SCI, responsible for about 30% of cases. This is particularly true among older adults, where even a seemingly minor fall can cause devastating spinal damage.
Acts of violence. Gunshot wounds and other violent assaults account for approximately 13% of spinal cord injuries.
Sports and recreation injuries. Diving accidents, contact sports, and other recreational activities cause about 9% of spinal cord injuries.
Medical and surgical complications. Approximately 5% of spinal cord injuries result from medical procedures or complications.
Recognizing Spinal Cord Injury Symptoms
Symptoms of a spinal cord injury may appear immediately or develop over time as swelling and bleeding affect the spinal cord. Warning signs include loss of movement or weakness in the arms or legs, loss of sensation including the ability to feel heat, cold, or touch, loss of bladder or bowel control, difficulty breathing, extreme pain or pressure in the neck, head, or back, numbness or tingling in the extremities, and difficulty with balance or walking.
If you suspect someone has a spinal cord injury, do not move them. Improper movement can cause additional damage. Call 911 immediately and keep the person still until emergency responders arrive.
Long-Term Effects of Spinal Cord Injuries
Unlike many injuries that heal over time, spinal cord damage is often permanent. People with SCI may face lifelong challenges including paralysis (paraplegia or quadriplegia depending on injury level), chronic pain, muscle spasticity and stiffness, respiratory complications (particularly with high cervical injuries), bladder and bowel dysfunction, sexual dysfunction, increased risk of blood clots and pressure sores, depression and emotional challenges, and autonomic dysreflexia (a potentially life-threatening condition in those with high-level injuries).
These complications require ongoing medical management, often including medications to control spasticity and pain, regular monitoring for skin breakdown and pressure sores, catheterization and bowel management programs, respiratory therapy for those with breathing difficulties, and mental health support.
The Enormous Cost of Spinal Cord Injuries
Spinal cord injuries are among the most expensive injuries to treat. According to national data, first-year costs for a high cervical injury with ventilator dependence can exceed $1 million, with annual costs of several hundred thousand dollars thereafter. Even less severe injuries result in hundreds of thousands of dollars in first-year expenses and substantial ongoing costs.
These expenses include emergency care and hospitalization, surgery and acute rehabilitation, wheelchairs, modified vehicles, and assistive technology, home modifications for accessibility, ongoing medical care and therapy, personal care assistance, and lost income and diminished earning capacity.
Over a lifetime, the total cost of a spinal cord injury can reach several million dollars.
Compensation for Spinal Cord Injuries in California
Given the catastrophic nature of these injuries, spinal cord injury claims often involve substantial damages. If someone else’s negligence caused your injury, you may be entitled to compensation for:
Past and future medical expenses. This includes all treatment costs from the date of injury through the remainder of your life expectancy—emergency care, surgery, rehabilitation, ongoing therapy, medications, medical equipment, and home health care.
Lost income and earning capacity. Many spinal cord injury victims cannot return to their previous employment. Compensation should account for lost wages during recovery and the lifetime impact on your ability to earn a living.
Pain and suffering. California allows recovery of non-economic damages for physical pain, emotional distress, and diminished quality of life. There is no cap on these damages in most personal injury cases.
Home and vehicle modifications. Wheelchair ramps, accessible bathrooms, modified vehicles, and other adaptations necessary for daily living.
Loss of consortium. Your spouse may have a claim for the impact the injury has had on your relationship and family life.
Building a Strong Spinal Cord Injury Case
Spinal cord injury claims require meticulous documentation and often expert testimony to establish the full scope of damages. Key elements include comprehensive medical records documenting your diagnosis, treatment, and prognosis, expert medical testimony explaining your injuries and future care needs, life care planning experts who can project lifetime medical and care costs, vocational experts who can assess your diminished earning capacity, economists who can calculate the present value of future losses, and evidence establishing liability against the responsible party.
Because the stakes are so high in spinal cord injury cases, insurance companies often fight aggressively to minimize payouts. Having experienced legal representation is essential to ensure you receive compensation that will truly meet your lifetime needs.
California’s Legal Framework
California’s two-year statute of limitations applies to spinal cord injury claims. Given the complexity of these cases and the time needed to understand the full extent of your injuries, consulting with an attorney promptly is important.
California’s comparative fault rules also apply. If you’re found partially at fault, your compensation will be reduced accordingly—but you can still recover damages even if you share some responsibility.
